Payment Schedule
The deposits and payments are due upon receipt of invoice. Invoices will be submitted to Guests at three periods:
• 50% payment shall be made upon receipt of invoice.
• A further 50% payment shall be made one month prior to arrival date.
Prices are quoted at the ruling daily exchange rate. Until Fairways to Africa has received payment of the Price in full, it reserves the right to charge any fluctuations to the Client’s account and the Client undertakes to pay for any such fluctuation on demand. The onus will be on the Client to check that there have been no changes in the Price prior to making full and final payment. However, once payment of the Price in full is received, the Price is guaranteed (subject to statutory increases such as VAT). However, airfares are subject to the price and conditions quoted by the airlines and cannot be guaranteed by the Fairways to Africa (PLEASE NOTE: This especially applies regarding airport taxes for the entire journey).
Should the Client be a group booking and the group number deviate from the number required for the Booking, the Supplier may reserve the right to re-cost the Price and raise a surcharge. Should any Client refuse to accept and pay such surcharge, it may result in the Supplier cancelling the Booking and retain any payment made (Fairways to Africa will be entitled to retain any service fees charged).
Please note that in some cases Supplies may nevertheless have a clause requiring passengers to pay an additional amount in the event of fuel surcharges or fuel price increases even though full payment has been effected.
Cancellation
The Client agrees that should they cancel this reservation for any reason, Fairways to Africa and our partners will suffer damages. Fairways to Africa cancellation policy mirrors the above payment schedule, based on non-refundable payments that are due to our suppliers.
• No cancellations will be valid unless received in writing by Fairways to Africa.
• Fairways to Africa’s cancellation Policy will mirror those of our suppliers, less any fee associated with the booking
• Third Party Cancellation policies shall also apply in the event of a reduction in room /people numbers

Force Majeure
Fairways to Africa will not be held responsible for loss, damage or additional expenses due to common carrier delays or changes, weather, sickness, strikes, labor disputes, war, quarantine, Acts of God, force majeure or other causes beyond our immediate and direct control.
Liability / Third Party Service Providers
Fairways to Africa provides Clients with travel and/or other services either acting as itself or acting as agents for suppliers engaged in or associated with the travel industry, such as airlines (‘collectively referred to as ‘the Supplier). Fairways to Africa represents the supplier as agents only and accordingly accepts no liability for any loss, damage, injury, illness, harm or death which any Client may suffer as a result of any act or omission on the part of or the failure of the supplier to fulfil their obligations, whether in relation to travel arrangements, accommodation or otherwise unless, in the case of injury or death, it is due to the negligent act or omission of the Fairways to Africa. The contract in use by the Supplier (which is often constituted by the ticket issued by the Supplier) shall constitute the sole contract between the Supplier and the Client and any right of recourse the Client may have, will be solely against the Supplier. Fairways to Africa will provide the identity and terms and conditions (or access thereto) of all the suppliers relevant to the service being provided for the Client’s booking. It’s the Client’s responsibility to familiarise themselves with such terms and conditions (‘the Supplier’s Conditions’).
Agreement and Understanding / Notice of Confidentiality
It is mutually understood that the above Terms and Conditions will be guaranteed with the acceptance of a quote provided by Fairways to Africa.
This information is confidential and cannot be shared with or provided to any other company(s) or supplier(s) that would be in direct competition with Fairways to Africa for this or any other type of reservation, event, travel incentive or other type of promotion. All of the above meets with my approval and I consider this Agreement to be definite and confirmed.
Fairways to Africa assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under Fairways to Africa’s control; and (4) any Supplier price drop after your travel arrangements have been confirmed, paid in full, or ticketed. You hereby release Fairways to Africa from all claims arising out of any problem covered in this paragraph.
Travel arrangements involving airline and car rental components are subject to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase.
You hereby consent to any such price increases and authorize Fairways to Africa to bill for those. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms. By accepting this quote or invoice you hereby consent to those terms and conditions.
Fairways to Africa has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance in your own personal capacity.
COVID-19
You agree that it is your personal decision to travel and that you are doing so with full knowledge of current travel recommendations and travel restrictions with regard to the risk of COVID-19, with you having taken full personal responsibility to inform yourself in relation thereto. Fairways to Africa does not assume any responsibility for and shall not be liable for any unsafe conditions or health hazards, including pandemics or other illnesses to which you may be exposed. Fairways to Africa will, however, use its reasonable endeavours to provide you with the latest travel information available to the Company in respect of the regulations, conditions and supplier terms applicable in relation to COVID-19, as at the time of your booking. This information is obtained from third party sources and is subject to change at any time without notice. The Company, its employees and agents, shall, accordingly, not be liable for any loss (financial or otherwise), damage, illness, harm, trauma, death, delay, denial of onward travel or costs (including but not limited to quarantine costs), which you may incur or suffer, whether during or post travel, arising directly or indirectly out of the risks and/or dangers associated with traveling during the COVID-19 pandemic, whether or not you had been informed by the Company of such risks and/or dangers at the time of booking.
Fairways to Africa is not responsible for the acts or omissions of travel suppliers, including the failure by the travel suppliers to adhere to their own schedules, provide services or refunds or their failure to honour any future trip credit.
Please note that most insurance policies have a specific clause stating that they do not cover epidemics and pandemics, especially when travel warnings are in place. It would be advisable for you to take advice from an insurance broker should you have any queries regarding the appropriateness of a travel insurance policy. Fairways to Africa shall not be liable for your election not to purchase insurance nor shall Fairways to Africa be liable to you for any denial of any claim by a travel insurer as it relates to COVID-19 or any other claim under the relevant policy.
“You are aware of the risks and dangers associated with travel during the Covid-19 pandemic and you expressly assume all of the risks and dangers in relation thereto; and hereby forever release, discharge and hold the agency, it’s employees, officers, directors, associated, affiliated companies and sub- contractors harmless against an and all liability, actions, causes of action, suits, damages, claims and demands of whatsoever nature which you may now have or which may hereafter arise out of or in connection with such risks and dangers”.
